ECF: The Problems and Our Solution

We have been involved in all aspects of ECF for nearly a decade. Early versions of CM-ECF (the court's new case management software) required attorneys to go through a set of nearly a dozen web forms re-entering all the information on the petition over again for a second time. For those without fast internet connections, the value of such an exercise was exclusively for the court. In response, the Bankruptcy Court in San Diego decided to streamline the intake process by having the attorney's filing software generate all of the data needed to open a case as a separate file. The goal was to eliminate duplicative entries and speed up the process.

Because of our long history with a variety of earlier ECF experiments, our software was selected as the testbed for this new feature that has since become known as "Case Upload", and is now a standard feature in most CM-ECF courts. Case Upload reduced filing times from nearly 10 minutes per case to less than one. But being browser based, even "case upload" is restrained by web browser technologies from streamlining any further, and not all courts have had the staffing to install and support "case upload". However, with Direct Upload Plus™, Bankruptcy2008™ frees the attorney from the browser and reduces the steps necessary for uploading a case to just three clicks in ALL districts.

Yes, It's Really This Easy

One button click and Bankruptcy2008™ creates all four (five on chapter 13) of your ECF files with no intervening windows, no drivers to select, no properties to set. Files are automatically named and stored in a pre-selected folder of your choosing awaiting either proofreading or uploading. Everything is automatic, from putting the "/s/ name" on all signature blocks of your pdf's to knowing the county code for every county in the entire U.S. Bankruptcy2008™ even knows what division to file your case in. All files are created in a matter of seconds -- no bankruptcy program generates smaller pdf files or does it faster.

Click on the upload button and a browse & attach window appears. No need to do anything -- your files will already be pre-selected for you. Preview buttons let you open your files for last minute proofing, editing, or touch-up if necessary. A second error check is run when this window opens to make sure you have nothing but valid data going to the court. If errors are found, the "upload" button will be marked "errors". Pressing it will give you a list of items to fix before proceeding. (Typical errors are omitting a zipcode, petition date, forgetting to select a county, etc.)

When "Upload" is pressed, Bankruptcy2008™ automatically connects your computer to the internet, contacts your court's server, logs you in with the login/password stored in your setup, uploads all the files to the court, retrieves a case number from the court, enters that number into your client's data file, starts your web browser, and displays the docket report showing your date stamped receipt from the court.



Case Filed!

When uploading ends, Bankruptcy2008™ retrieves your case number from the court's computer, enters it for you into your clients case file, and automatically starts your browser to display the official docket report.
